Where in a mortgage note does not specify whether or not a loan is considered non-recourse or recourse?
I bought a house 4 years ago and now I can not pay my mortgage. I have a TD first and second, the first being refinanced once as a type / refinancing long term and, secondly, a subordinated loan with Wells Fargo, has been partly used to pay. I must consider exclusion as an option if the lender is not willing to change the terms, but I'm sure the creditor is in 1st or 2nd May continue any of my other assets, including my wife owns property free and clear he was with his grandmother, a decent enough size (over 100,000) 401K, or possibly even the attachment of my wages. Credit and tax issues aside, is it possible that the lender seek payment through the judicial system, or close to protect near me? BTW this house is considered my home Main. I am also trying to find where in the note or deed Trust that I signed, indicates whether the mortgages are considered an appeal or without recourse, but does not seem to find the verbiage associated
If the house is the only guarantee listed in the note that's all I can take.
