tenants foreclosure rights florida

July 4th, 2008 by admin

Our landlord has been served for foreclosure. What are our rights and obligations as tenants?

We feel horribly for him, as he is losing several properties. He has been just wonderful, and we have been good, responsible tenants as well. However, this situation isn’t good for any of us, and I understand that we as mere renters have little recourse.

We paid this month’s rent on time as usual, just days before we found out he was being served. What are our responsibilities in this situation? We’re probably not going to have hardly any time to find another home to rent.

An attorney will be difficult to afford along with the money we’ll be needing to make another property’s first & last month’s rent and pet deposits. But should we consider it just to be safe?

Our state of residence is Florida.

I don’t think you’ll have to hire an attorney. It was already pointed out you could sue – except your landlord has already spent and lost everything, so what could be gained by that?

You should be able to get free information on your rights as a rentor from a local realtor, the tax assessor’s office, or even your state’s government website. If these don’t have the specific answers, they should be able to refer you to someone who can help.

I don’t believe there is one catch-all answer – it will vary by state.

Best wishes to you! Hope you find a place you’ll enjoy even more….
