
How do I find a real estate attorney on a contingency basis in the Phoenix Metro area?
My boyfriend of 13 years and I bought a house together in 2002. He broke up with me in 2004 and I moved out. Both names are on the deed, his name is on the loan. We shared expenses when I lived in the house. He doesnt want to share the equity of the home because I moved out. I want to get my name off the deed but do not want to GIVE him the house and asked for 1/2 of the current equity. He is not willing to share the equity since I was the one to move.
The situation you describe is not really a real estate question, since the jointly owned property could just as well be a pair of shoes, a bank account, or a car. In this case, I’d contact a divorce attorney – since you’ve been together for 13 years (and in this property together for quite a while). Even though you’re not “married”, you share household assets, and probably will need a court to either grant you a portion of the assets (like a settlement), or issue an injunction that keeps your boyfriend from selling the property until you can come to an agreement.
