Private Lender Note Clauses that make you money!

One of the most important documents you will ever sign with a private lender is the actual score that creates the loan obligation. In a typical private lender transaction, you, the real estate investor (borrower), borrow money from an individual (private lender) and the transaction is documented by a note and mortgage.

The note sets out the terms and conditions under which the private lender is willing to lend you money and where you're ready to borrow money. The mortgage is the security document for the performance of the borrower under the note and is usually guaranteed a property that you own or are about to purchase.

The Note is where you want to control the process of private loan in your favor and give you the control and flexibility you may need in the future. If the note does not contain clauses of law, you are potentially giving away a huge check your private lender, and finally tying the hands.

When dealing with lenders private, it is extremely important that you stay in control of your options for the future.

If you were to go to your local store for supplies office and buy a model form of notes, you are potentially leaving your control over the future of your private lender, without even what happens.

We recommend the following two clauses in a ticket with a private lender:

Substitution of the warranty clause

"The borrower has the right to substitute, as a guarantee of equal or greater value"

The substitution of the guarantee clause allows you to sell the underlying real estate, without reimbursing the private lender Note substituting the guarantee with a room different properties of equal or greater value.
