The difference between Chapter 7 and Chapter 13

The main purpose of bankruptcy law is to give people a start desperately indebted financial costs. bankruptcy filings are public documents. However, under normal circumstances, we will know the bankruptcy. Credit Bureaus will maintain a record of Bankruptcy and will remain on the credit report for 10 years.

The most common reasons for bankruptcy filings are unemployment, large medical expenses; Credit seriously overloaded, marital problems, and other large unexpected expenses.

There are two ways a debtor can fail. The first and most common way is for a person to file a voluntary petition asking the Court to allow the bankruptcy. The second and rarely used elsewhere, is for creditors to ask the Court for an order that a person is bankrupt. In this way, a creditor can get the payment, at least in part, for the debts of a debtor refuses to pay. In both cases, a bankruptcy Trustee is required to administer the bankruptcy.

There are two types of moral bankruptcy.

Chapter 7, also called straight bankruptcy is a liquidation proceeding. Debtor gives all non-exempt property to a trustee in bankruptcy who later converted to cash for distribution to creditors. The debtor is discharged of all debts for release, usually within 4 month. Chapter 7 is filed in cases where the debtor has few assets to lose, this option gives a fairly rapid release debts. The debtor may file Chapter 7 again if more than 8 years have passed since the discharge of a Chapter 7 bankruptcy.

Chapter 13 Bankruptcy is also called a bankruptcy reorganization. It is filed by individuals who wish to pay their debts in 3 to 5 years. This type of procedure is suitable for people with non-exempt property they wish to keep. It is only an option for people who have predictable income and whose income is sufficient to pay the reasonable expenses with some amount left over to repay their debts.

Under the new bankruptcy law, which took effect on October 17, 2005, people who can afford to make repayment of their debts must file Chapter 13. Only debtors who meet the requirements stringent financial are allowed to erase their debts completely through Chapter 7. Debtors must take an approved course advice Financial within 6 months of filing. Then, their income is assessed as (average monthly-fee) X 60. If the result is $ 6,000 or less, and unsecured debts are less than 25%, Chapter 7 is allowed. If income exceeds $ 10,000 and unsecured debts are greater than 25% the debtor must file Chapter 13.

Once the bankruptcy is filed, creditors are prohibited from harassing the debtor. By law, creditors can not initiate or continue a lawsuit, garnishment of wages, or even make telephone calls demanding payments. Secured creditors such as banks holding, for example, a lien on a vehicle, get the stay lifted if the debtor can make payments.

Spouses are not legally affected by the bankruptcy of a debtor if they are not responsible (did not sign an agreement or contract) for any of the debt. If they have an additional credit card, they are probably responsible for this debt. However, in community property states, a spouse may incur a debt without the other spouse's signature on anything, and the spouse will still be required to pay. There are some exceptions to this rule, such as purchase or selling property; these few exceptions do not require the signature of both spouses on the contract for both to be responsible. But ordinary purchases, such as credit cards, do not require both spouses to have signed. States property of the Community are: Arizona, California, Idaho, Louisiana, Nevada, New Mexico, Texas, Washington and Wisconsin.

the declaration of bankruptcy does not mean that subsequent access of the individual credit is cut. If a debtor has the right to keep the credit cards after bankruptcy filing is the company credit card. If the bankruptcy means discharging a credit card, the issuer will cancel the card unless the debtor reaffirms the debt. Even if the card has a zero balance of the company credit card could still cancel the card.

A number of banks now offer "secured credit card", for which the debtor sets up a certain sum of money (as little as $ 200) in an account at the bank to guarantee payment. Initially, the credit limit is equal to the secured and is increased as the debtor demonstrates ability to pay the debt.

Two years after a bankruptcy discharge, debtors are eligible for mortgages on equal footing with the candidates of the same financial profile, who have not declared bankruptcy. stability of income and the size of the deposit are considered more relevant than a past bankruptcy. Although bankruptcy stays on a credit report for 10 years, it becomes less important as time passes. Those who have declared bankruptcy are often better credit risks than people who do not and are struggling to pay several debts.
Debtors filing for bankruptcy are allowed to keep certain assets. Exemption for an institution is limited to $ 125,000 if the property was acquired in 1215 days Previous (3-3 years). The limit does not apply to any interest transferred from a debtor's previous principal residence that was acquired before the start of the 1215-day period. The value of the farm exemption is reduced by any addition to the value caused due to a sale of nonexempt property made by the debtor in order to evade or defraud creditors during the 10 years preceding the bankruptcy filing.

An absolute $ 125,000 homestead cap applies from if the Court determines that the debtor has been convicted of a crime demonstrating that the filing of the case constituted an abuse of the provisions the Bankruptcy Code, or the debtor owes money due to criminal acts. This limitation does not apply if the homestead is "reasonably necessary to support the debtor and any dependent of the debtor. "

Some laws relating to bankruptcy vary from state to another. legal residence is determined by which state the debtor lived in the 730 days (2 years) before filing, or if the debtor does not live in one state during the previous 2 years, the State where the debtor has spent the majority of period preceding the 2 180 years. If it leaves the debtor ineligible for any exemptions then the debtor has the right to use federal exemption laws.

In some cases, Chapter 7 bankruptcy, tax debts are eliminated, but only if strict conditions are met: the IRS does not tax lien on the debtor's property and no fraudulent tax returns were filed, the Tax liability is due to a statement filed at least 2 years before the bankruptcy filing, the tax return is due at least 3 years and taxes have been evaluated at least 8 months before its bankruptcy.

Student loans from government and private organizations are generally not eliminated, unless such repayment would cause undue hardship to the debtor.

All non-exempt assets such as real estate, Cars and motorcycles will then be liquidated by the trustee.

There is no legal obligation to use a lawyer to file for bankruptcy, and debtors may themselves for about $ 300, however, it is strongly recommended to use the services of a lawyer specializing in bankruptcy bankruptcy law is complex. A bankruptcy lawyer is worth the cost, which is usually only $ 1,600 to $ 2,000. Accounts receivable recover legal costs many times the peace of mind and the avoidance of stress, in addition to real money saved by following the advice of counsel in bankruptcy.
