
In the midst of a divorce… can I sue my ex for financial damages?
I’m in the midst of a divorce. I’m a stay at home mother with four kids and my soon to be ex makes $180,000 a year. In our temporary orders, judge ordered him to pay family credit cards and mortgage on the house I am living in with the kids. He chose not to do that. This is also a domestic violence case and I know already that this is just a typical dv move — financial abuse. Now, my credit is ruined and my house is in foreclosure. I can’t rent another place because of no job/ ruined credit (i’ve tried). Can’t go to work again full-time because of special needs child. So, we have a current $1,000,000 personal umbrella insurance policy. Can I sue my husband in a civil lawsuit to save my house/ get damages from the umbrella policy? I’m in the state of Washington.
If he didn’t follow the orders to pay the mortgage and credit cards, you should’ve filed a motion to hold him in contempt. You can’t file another claim in another court. Your claims are already being handled by the divorce proceedings. You need to file a motion, as soon as possible. It may be to late to save your home, but he still owes you that support. Better get an attorney, sounds like you have a fight on your hands. Search “[your county] Washington legal aid,” for services based on income. Good luck.
