
How long would it take to evict the former owner (but the current occupants) of the house purchased in selling, VA?
The Bank has approved our offer of selling a home in pre-foreclosure. The current owner told us only moves forward with the solution if you can get two months' arrears of rent to pay, while finding a place to go. If you are come to this, and I accepted this offer, how could Actual holder to extend his stay beyond the two months – by filing bankruptcy or other legal means which could help advance an eviction? Obviously I will not move forward unless you know that you can control when they vacate the property. How long could squat once I settle into the house before having been evicted? Once again – for lawyers there – it is in the State of Virginia. Thank you!
If you stay beyond of two months you can take steps to expel him cons – the legal term is in fact an "unlawful Detainer" the action. In normal cases may be completed in 2-3 weeks. However, if it is fighting in court, you can drag another 2-3 months. In the cases I have seen a nightmare where the deportees befroe fought for 18 months finally beeing blocked by the sheriff. Generally the purchase of foreclosure and short sale: Never leave former owner to stay in the property. NEVER! A better idea is to pay rent for their first 2-4 months in another property – that is, must be move – but will pay for the deposit and two months' rent to another site if it is out of the house on time.
