Who receives the proceeds from the sale of foreclosure?

If a North Carolina home is closed on and sold more than the amount due on the mortgage, the borrower does not receive the excess funds?

There is a possibility, yes. The base line as to Who gets the money would be: 1) Court / cost of the auction, the sale would be paid 2) The holder of the mortgage above (First mortgage) 3) any claim Junior (Second mortgages, etc.) 4) Although the owner depends on what type of exclusion is used. In general, the locking point is the repayment of mortgage debt, not to take possession of property. Honestly, however, this market would be surprising if a property to sell enough to pay the mortgage. If the property is not enough to repay the debt against them, most States allow the lender to a deficiency of the sentence, to be held by the owner of property liable for the remainder of the balance, unless is a clause in the mortgage to say something different.
