Generally not. Judicial and non – judicial foreclosure are available, but no-trust lawsuit is widely preferred. California has a rule of action for the lender must choose an action to take against the borrower if the borrower. If the lender does not trust out of court, the lender has chosen an action, can not sue to recover a deficiency, what would be a second action. If the lender decides to pursue the borrower and obtain both a foreclosure order, and if the proceeds of judicial sale real estate are not sufficient to pay the loan balance, then a deficit is allowed. Such action is authorized as a creditor in a single action. California lenders rarely elect judicial seizure. The debtor may reinstate up to five days before the non-judicial foreclosure sale. Jugement N deficiency allowed after a non-judicial foreclosure or exclusion of a purchase price of the mortgage. If the lock is legal, a lack of decision is allowed whether the exclusion is not a purchase price of the loan. California-action rule requires the lender to foreclosure and is disabled at the same time. If the lender decides to exclude only he can decide not to sue for a deficiency later.
