I need the advice of a real estate agent or a lawyer PLEASE !!!!!! Foreclosure !!!!?
Hello … We have a mortgage on a home in Debary, Florida, is not worth what we owe. We also have a home in Howard, Ohio. My question is … mortgages are different, but Charles Schwab is the holder of the mortgage of two and the house in Florida, we believe that we will have to close. Will they (the bank) to place a lien on the second house in Ohio? Would we to sell the second house on Ohio foreclosure before entering or being able to keep the house in Ohio, regardless of the bank to place a lien or try bring home Ohio. Please advise. Thank you very much, Stacy
Technically, the two properties are not connected, and can not be the privilege of the second property for pay the funds due to the first property. Legally, they need to start the eviction process. Once excluded, because it is the liquidation of assets. Any difference between what they receive, and what is technically still owned by you. In most cases, this difference is written off (sorry) by the bank, and move on. However, by law, may apply for refund to sue for the difference, obtaining a trial, then the property of others liening bank / / Off. But why we can not exclude the second property to obtain a refund, but only one is a privilege. So if you decide that the privilege does not really matter if you have a mortgage or not. You can always favored the assets you have.
