Colorado, the disclosure requirements of Hoa

The owners of disclosure

With the passage of SB100, Colorado Statues now require that every homeowners association in the state to provide at least annually, within 90 days after the end of each year, information after all the owners reasonable notice:

• The start date and fiscal year operating budget for the year fiscal year.
• A list, by unit type assessment of the current owner, including regular and special assessments.
• Their statements annual financial audit results and a list of all insurance association.
• Articles of association, articles and rules and regulations.
• Every minute the Executive Board and membership meetings for the year preceding the current fiscal year.
• Responsible management policies Association

This information should be readily accessible at no cost to owners at their convenience. Availability of media can be posted on a website which a notice is sent first class or by email and can be maintained under the literature table or the link to the page of the Business Association, or can be mailed or hand delivered to owners. The cost of any distribution must be recognized as a liability for common expenses.

Disclosure housing owned by the seller

SB 100 provides that, except in the case of a foreclosure sale, the seller of a property in a community common interest must mail or deliver to the purchaser the latest copies of the following documents:

1. regulations and standards of the Association;
2. restrictive clauses;
3. operating budget of the Association;
4. the declaration;
5. Association Annual Income and the statement of expenditure;
6. Minutes of the owner's most recent annual meeting and all Executive Committee meetings held in the six months immediately preceding the date of the law, and this
7. Check Association.

This law requires Owners Association of suppliers to provide detailed information to the buyer before the deadline, or in the case of a sale by owner no later than 10 days before closing.

The new law also states that "written notice of this provision was not satisfying any of the documents listed above, is cause for termination of contract, if signed by the buyer or the buyer's name and Seller given on or before the date of administrative documents. "unit of time shares are not included in these conditions.

HOA Disclaimer

The association should make every effort to respond to a request for documents suppliers. The Association may charge a reasonable price does not exceed the actual cost per page of associations, and should make the documents available within 5 days receipt of the notification.
